The changes to the Construction (Design and Management) (CDM) Regulations (1994) will have significant impact on landscape professionals.

The new CDM Regulations 2007 come into force on 6 April and will revise and bring together the existing CDM Regulations 1994 and Construction (Health Safety and Welfare) Regulations 1996 into a single regulatory package.

The JCLI Agreement for Landscape Works has been withdrawn because it conflicts with the revised CDM Regulation 2007.  JCLI Practice Note No 6 (April 2007) which is available on the Landscape Institute website www.landscapeinstitute.org, advises on the interim use of the JCT Minor Works Building Contract 2005 (with its Amendment 1 of April 2007) for landscape construction projects.

It is intended that a new Edition of the JCLI Agreement for Landscape Works will be available by the autumn of 2007.

Details of the most significant revisions to the Regulations and other information are available on the Health & Safety Executive (HSE) website: www.hse.gov.uk. The Approved Code of Practice for the Regulations “Managing Health and Safety in Construction”, which includes the Regulations, is available from HSE (web-site or Tel 01787 881165).

JCLI Practice Note No 7 (February 2002) has been revised to update it to take account of the 2007 Regulations and is available on the Landscape Institute website www.landscapeinstitute.org
